Defendants lose bid to postpone compensation payment to single mother, judges also award her RM2,000 in costs

KUALA LUMPUR – The Inspector-General of Police (IGP), government and two others have lost their bid to postpone from paying RM14,000 in court-awarded costs to M. Indira Gandhi. 

The court-awarded costs were derived from the RM10,000 amount ordered by the high court on July 16, 2021, for dismissing the defendant’s striking out application against RM100 million suit brought by Indira Gandhi, and RM4,000 in costs awarded by Court of Appeal after they upheld the high court’s decision on September 7 last year. 

Today, high court judge Raja Ahmad Mohzanuddin also awarded another RM2,000 in costs to Indira after dismissing the defendant’s application for stay of execution today. 

On October 28, 2020, the single mother had filed a RM100 million suit against the four defendants including Home Ministry and the Royal Malaysian Police for their failure to locate and return her daughter, who was allegedly abducted by her ex-husband. 

In her suit, the kindergarten teacher claimed that the defendant’s had committed negligence and misconduct when they failed to take necessary steps to apprehend Pathmanathan, now known as Muhammad Riduan Abdullah. 

She also stated in her claim that she suffered anxiety from constantly worrying over her daughter’s safety and wellbeing, and claimed for general as well as exemplary damages against all the defendants. 

Her ex-husband, Muhammad Riduan had unilaterally converted their three children to Islam in 2009 without Indira’s consent. However, the Federal Court in 2018 has ruled that the conversion is null and void. – December 4, 2023
