Lawyer Rosli Dahlan files judicial review over frozen accounts, travel ban

KUALA LUMPUR – Lawyer Rosli Dahlan has filed for a judicial review against the police force and government to challenge their alleged actions of linking him to a complaint filed by AirAsia on payment gateway i-Serve. 

In an affidavit filed on December 29, Rosli suggested that this association resulted in his arrest, money-laundering investigation, freezing of bank accounts, and imposition of a travel ban. 

Rosli filed the review through Messrs Vin Law Co, naming key figures such as Inspector-General of Police Tan Sri Razarudin Husain and commercial crime chief commissioner Datuk Ramli Mohamed Yoosuf among the respondents.

In the application, Rosli sought a certiorari order to annul the police force’s purported actions under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, asserting no connection between him and the AirAsia v I-Serve complaint. 

He also aimed to nullify the arrest, remand, travel ban and freezing order for bank accounts and Permodalan Nasional Bhd accounts, citing violations of constitutional rights.

Additionally, Rosli requested a mandamus order to lift the travel ban and compel authorities to disclose the basis for his arrest. 

He claimed the persecution began after representing former prime minister Tan Sri Muhyiddin Yassin, alleging a conspiracy involving the Malaysian Anti-Corruption Commission (MACC) and police. 

The accusations, he claimed, stemmed from a false narrative connecting him to an investment scam involving i-Serve and MYAirline, following the collapse of the latter.

“The MACC had created a false narrative that was leaked to the mass media that I/my firm had received inducement/bribes and/or siphoned 1MDB funds that were later used through other business activities. This is a baseless and malicious allegation,” he said.

Rosli also claimed that the police report made by AirAsia against i-Serve regarding credit top-up form transactions in 2018 had led to his detention. 

However, he contended that these transactions had no relevance to him.

Rosli asserted that the freezing of his accounts disrupted financial obligations, leading to his application for a judicial review. 

The hearing is scheduled for February 19, where he aims to challenge the alleged abuse of power, procedural impropriety and mala fide actions by the authorities. – January 3, 2024
