No fireworks past midnight: police issue guidelines ahead of CNY celebrations

KUALA LUMPUR – Police have warned the public against celebrating with fireworks after midnight throughout this festive season, saying offenders face possible imprisonment and fines.

In a guideline issued for the sales and usage of fireworks for the upcoming Chinese New Year celebration, Bukit Aman police secretary chief Alzafny Ahmad said the order was made to avoid jeopardising public safety.

“The public is also reminded against playing with fireworks after midnight, which could create disturbances or endanger the general public,” he said in a statement today.

He said offenders face action under Section 13 of the Minor Offences Act 1955 or Section 7 of the Explosives Act 1957, which could lead to seven years of jail time, a fine of RM10,000, or both.

Meanwhile, Alzafny also advised the public to use fireworks in open spaces to avoid disrupting public order and causing annoyance to residents.

He added that people should practice safety measures and constantly be aware when using fireworks in any festive celebration.

On the sale of fireworks, Alzafny stressed that it is only permitted during local celebrations, which are Aidilfitri, Aidiladha, Chinese New Year, Deepavali, Christmas, Gawai Dayak, and Kaamatan Festival.

A total of 45 types of fireworks have been approved for sale since 2018 by adhering to the issued standard operating procedures – 36 of which are approved for general sales, while the remaining nine are conditional and can only be sold by licenced agents.

The terms that sellers must observe for both categories include having storage spaces that are secure and approved by the Police Arms Division, having sale licences that cannot be transferred, and selling fireworks sold by licenced shop owners.

He said a single licence can only be issued to one applicant per location, while the sale of fireworks to minors under 18 years old is strictly prohibited.

Firework sales through online platforms are also prohibited and are illegal under Section 8 of the Explosives Act. – February 9, 2024
