YDPA consented to new laws addressing cybersecurity, cyberbullying: Fahmi

Communications minister says this involves the Communications and Multimedia Act, Penal Code, and Online Security Act

CYBERJAYA – Amendments to the Communications and Multimedia Act, the Penal Code on cyberbullying both online and offline, as well as the Online Security Act, are set to be gazetted soon to tackle cyber threats and security issues. 

Communications Minister Fahmi Fadzil said that the enforcement of these laws follows consent from Yang di-Pertuan Agong Sultan Ibrahim. 

“Yesterday, I was informed that the Yang di-Pertuan Agong has granted his consent to amendments to the Communications and Multimedia Act, the Penal Code on cyberbullying both online and offline, and the Online Security Act,” he said. 

“Once gazetted, InsyaAllah, we will be able to address several issues, including online paedophilia, sexual crimes against children, cyberbullying, and related problems,” he added. 

He made these remarks during his speech at the launch of the Sebenarnya.my chatbot today. 

Also present was Tan Sri Mohamad Salim Fateh Din, Chairman of the Malaysian Communications and Multimedia Commission (MCMC).

Last December, the Dewan Rakyat approved the Communications and Multimedia (Amendment) Bill 2024. The bill passed with a division vote, with 59 MPs in favour, 40 against, one abstention, and 122 absent.

During the debate closure, Fahmi explained that Section 233 of the Communications and Multimedia Act 1998 (Act 588) would not be repealed to prevent the misuse of networks by parties for commercial purposes, particularly the sale of pornography and paedophilia. 

“The issue with Section 233 is essentially the abuse of networks. If this section were repealed entirely, it would allow scammers and paedophiles to thrive,” he said. 

As for the amendment to Section 211, he noted that it would not apply to the public but would be used for Content Application Service Providers (CASPs), with the fines in the section updated to reflect current developments. 

“The existing fines in this act are based on the value of currency in 1998. In terms of the industry, especially for telecommunications, we’ve found that many of the fines imposed no longer align with, for example, the revenue of telco companies today. Therefore, we see the need for alignment,” Fahmi added. 

The bill also proposed replacing the term “obscene content” with “harmful content” and introduced adjustments such as removing the phrase “or others who use the content application services” and changing “offensive” to “grossly offensive.” 

Furthermore, Section 211(c) will replace “individual” with “content application service provider” and amend the penalty from “RM50,000” to “RM1 million.” 

Additionally, the bill outlines proposed prison sentences of up to five years, or a fine of RM500,000, or both, for offences involving children under 18. It also suggests a new subsection in Section 233 that imposes different and harsher penalties if the offence is committed against a child under 18, classifying the crime as an arrestable offence. 

The new subsection also stipulates that offenders could face an additional RM5,000 fine for each day the offence continues after conviction. 

On December 11, the Dewan Rakyat also passed the 2024 Online Security Bill, aimed at enhancing and promoting online security in Malaysia. – January 28, 2025
