Writ witnessed by court registrar states SASB seeks declaration that  development agreement, subsequent additional agreements cannot be enforced

KUALA LUMPUR – SPNB Aspirasi Sdn Bhd (SASB), a subsidiary of Syarikat Perumahan Negara Bhd (SPNB), has issued a writ of summons against 12 individuals and entities over alleged “conspiracies” in a commercial development project.  

The writ, which was witnessed by Kuala Lumpur High Court deputy registrar Aisyaf Falina Abdullah on September 24, stated that SASB is seeking for a declaration that a development agreement and subsequent additional agreements cannot be enforced.  

Referring to eight “conspiracies” in the writ, among the compensation sought by SASB are RM108 million in loss of commercial opportunities under the development agreement, as well as indemnity over legal and consultative expenses borne by the company.  

It is also seeking RM33 million in real estate costs paid to Tunas Manja Development & Construction (KL) Sdn Bhd (TMDCKL) as well as a declaration that a “No. 1 interim payment certificate” is null and void.   

The writ also states that general compensation as well as that over the “conspiracy to commit fraud” will be determined at a later date.   

According to the writ, SASB has named companies TMDCKL, Tunas Manja Development & Construction Sdn Bhd (TMDC), and Akitek Akiprima Sdn Bhd as defendants.  

Individuals named include Datuk Chin Yoke Choon, Datuk Chin Yoke Kan, Datuk Chin Tham Hui, Rusli Ismail, Nohasina Muhammad Hakim, Datuk Cheah Kah Lip, Datuk Ahmad Azizi Ali, Hisham Ahmad, and Datuk Leong Yeng Kit.   

Besides that, the writ calls for compensation from Ahmad Azizi for “breach of statutory, fiduciary and/or common law obligations towards SASB” as well as from Hisham Ahmad for “duty of good faith and loyalty incurred against SASB.”  

SASB is also seeking compensation from Yoke Choon, Yoke Kan, Tham Hui, TMDCKL, Rusli, Norhasina, Akitek, Cheah, and Leong for “dishonestly assisting” Ahmad Azizi.  

According to the court’s e-filling schedule, the summons will be up for review tomorrow morning at the Kuala Lumpur High Court. – September 25, 2023
