Heartbreaking case: online seller charged for toddler’s death due to neglect

2-year-old died after being left unattended in car for several hours, leading to charges against the mother

PETALING JAYA – A 38-year-old online seller was charged today with negligence, which eventually caused the death of her 2-year-old toddler. 

Nur Sari Fardiana Mohd Amran was charged under Section 31(1)(a) of the Child Act 2001 for neglecting Airis Heidi Mohammad Hafiz between 8am and 3.15pm on November 11 by leaving the latter in a car parked in front of a house in Ara Damansara. 

Airis Heidi, the accused’s youngest of three children, died after being left in the car for several hours. 

The accused pleaded not guilty to the charge and claimed trial before sessions court judge Syahliza Warnoh this morning. 

The charge carries a maximum RM50,000 fine, 20 years’ imprisonment, or both upon conviction.

Deputy Public Prosecutor Anis Hakimah Ibrahim initially proposed to the court that the accused be granted RM15,000 bail and not disturb prosecution witnesses. 

She also suggested that the court order the accused to report to the police station once a month. 

Nur Sari Fardiana’s lawyer, Datuk Hanif Hassan, then pleaded for a bail amount lower than RM5,000 as the accused lost her child in the offence. 

“My client (the accused) is still suffering from trauma following this incident, which distracted her focus from her business, resulting in her business going downhill.”

The court then set bail at RM7,000 and ordered the accused to report to the police station once a month and not disturb the prosecution witnesses. 

The judge also fixed January 30 for mention.

Petaling Jaya district police chief Mohamad Fakhruddin Abdul Hamid said on November 9 that the incident happened when the mother forgot to drop the deceased off at the kindergarten.

He said she had dropped off two of her children at a nearby school before handling her online business when she reached the kindergarten. 

She then forgot to drop the victim off before realising that the victim was in the car around 3.35pm the same day. – December 22, 2023
