Cyberstalking case: Safiq ordered to enter defence, opts to remain silent

Defence says will call Hospital Bahagia forensic psychiatrist as its sole witness

SHAH ALAM – The magistrate has ordered Mohd Safiq Rosli to enter his defence against a charge of cyberstalking.

Magistrate Sasha Diana Sabtu said the prosecution had successfully adduced credible evidence, so a prima facie case had been established.

She then gave the accused three options: to either give sworn evidence from the witness box; give an unsworn statement from the dock where he cannot be cross-examined; or choose to remain silent, in which the court must proceed to convict him.

To which, Safiq’s lawyer Fithril Hakim Ab Jalil informed the court that the accused had chosen to remain silent.

He also said the defence would call consultant forensic psychiatrist Dr Ian Lloyd Anthony, of Hospital Bahagia Ulu Kinta, as their only witness.

Earlier, the court heard testimonies from two prosecution witnesses, the victim Acacia Mardiana Daud and investigating officer Mohd Hafizi Ismail, who investigated the case against Safiq before it was brought to court.

I am traumatised and fear for my safety due to this man’s (Safiq’s) constant harassment and stalking, to the point where I’m scared to leave my house.

“It disturbed my work, daily life and my future. I’ve been living in a state of fear,” Acacia told the court.

Safiq was charged on August 10 under Section 507A of the Penal Code, which carries a maximum sentence of three years in jail, a fine, or both upon conviction.

He claimed trial then and was granted bail on November 9, which has not been posted until today.

The charge sheet states that Safiq, also known as “Sopert” in Acacia’s social media posts, should have known his actions would incite fear in the victim.

The case made headlines when Acacia took to her social media platforms to share her experience with Safiq, which allegedly began in 2016. – January 17, 2024
