Confession under Evidence Act recorded from one of Zayn Rayyan’s parents

Police did not say which parent was involved in the closed proceeding in court today

PETALING JAYA – One parent of murdered autistic child Zayn Rayyan Abdul Matiin had a confession recorded under the Evidence Act 1950 today, said a police source.

“One of them had a confession recorded under the Evidence Act,” the source said when contacted.

The source however, refused to state which parent or to elaborate further.

Earlier, lawyer Mahmud Jumaat, who is representing Zayn Rayyan’s mother Ismanira Abdul Manaf, said charges related to Zayn Rayyan’s murder would only be proffered tomorrow after scores of journalists had gathered outside the court complex expecting developments today.

Mahmud this afternoon told reporters that Ismanira was in closed proceedings before a magistrate under Section 26(1) of the Evidence Act, but did not make any guilty plea.

She instead gave evidence to counter “what is being alleged out there” of her supposed guilt and involvement in the murder, Mahmud said.

Meanwhile, lawyer Fahmi Abd Moin, who is representing Zayn Rayyan’s father, Zaim Ikhwan Zahari, told Scoop at the court complex that he was only informed at 9am today of his client’s presence in court.

He refused to comment further until after the proceedings for Zaim today.

Earlier, Ismanira was seen arriving at the courthouse at about 10.30am. Several individuals believed to be her family members entered the courthouse at 10.55am.

Fahmi and Zaim arrived at about 11.15am. 

Under Section 26(1) of the Evidence Act 1950, a confession recorded while under police custody cannot be used against the person in court, unless it is made in the presence of a sessions court judge or magistrate.

Zayn Rayyan’s parents were arrested by police on May 31 and were remanded for seven days from June 1 to assist in the investigation into the 6-year-old’s murder. 

On Friday, the magistrates’ court allowed police to extend their remand for another six days until tomorrow. 

Selangor police chief Datuk Hussein Omar Khan said the extended remand period was necessary to verify certain matters and discrepancies within their systems.

On Monday, Ismanira was brought back to Idaman Apartments in Damansara Damai to re-enact the events leading up to Zayn’s disappearance and the discovery of his body.

Zayn Rayyan’s body was found in a creek about 200m from his family’s home on December 6, last year. – June 12, 2024
