Zayn Rayyan’s case: defence requests victim’s name to be changed

KUALA LUMPUR – Slain autistic boy Zayn Rayyan Abdul Matiin has had his name changed in the charge sheet against his parents who are accused of child neglect.

The parents’ lawyer, Fahmi Abd Moin, told the Petaling Jaya sessions court today of the name change to Zayn Rayyan bin Zaim Ikhwan, New Straits Times reported.

Zaim Ikhwan Zahari is Zayn Rayyan’s father, who was charged along with the boy’s mother Ismanira Abdul Manaf with child neglect on June 13.

“We have received documents from the Selangor National Registration Department (NRD) through Ismanira correcting the information in Zayn Rayyan’s birth register… I would like to record our request to amend Zayn Rayyan’s name in the charge sheet,” Fahmi told sessions court judge Dr Syahliza Warner today.

The lawyer added the change was made in the register on July 4, while also submitting a copy of the new birth certificate to the court today.

Deputy public prosecutor Nurul Qistini Qamarul Abrar also confirmed the prosecution received the new birth certificate this morning.

Judge Syahliza told the prosecution to confirm the change with the NRD, and for the matter to be reviewed at the next case mention.

Previously, Fahmi had represented only Zaim Ikhwan, while Ismanira was represented by Mahmud Abdul Jumaat.

Today, Mahmud said he was no longer representing the Zayn Rayyan’s mother, who terminated the services of Mahmud’s law firm. The lawyer also told Scoop he was “not the right fit” for the case.

Ismanira and Zaim were charged under Section 31(1)(a) of the Children Act 2001 with neglect of Zayn Rayyan, a child they have custody of, to the point that it may have caused him injury.  

They were accused of committing the offence on December 5 last year at around 12pm until December 6 at around 9.55pm. It was allegedly committed at Jalan PJU 10/1, Damansara Damai. 

The charges were brought under Section 31(1)(a) of the Child Act 2001, read together with Section 34 of the same act, which provides for a maximum fine of RM50,000 or imprisonment of up to 20 years, or both, upon conviction. 

On December 6 last year, the 6-year-old’s body was found near a stream near the Idaman Apartments, Damansara Damai.  

A post-mortem indicated that the child was killed, based on injuries found on his neck and body. – July 26, 2024
