How can there be a fair trial if prosecution blocks access to important documents?: Wan Saiful

KUALA LUMPUR – Bersatu’s Tasek Gelugor MP Datuk Wan Saiful has expressed concerns about receiving a fair trial in his money laundering and corruption case tied to the Jana Wibawa project, citing restrictions on his lawyers’ access to vital evidence documents.

In a Facebook post, Wan Saiful said that at the beginning of the trial, the prosecution informed the court that they were unwilling to provide certain documents requested by his lawyers.

“My lawyers protested because this limits our access to relevant and crucial documents for the defence. How can there be a fair trial if the prosecution is blocking access to important evidence documents?

“My lawyers stated that if the prosecution is so reluctant to provide these documents, it suggests that they are indeed important. If not, why are they so hesitant to share the available documents?” he asked.

Last October, Wan Saiful was charged at the Kuala Lumpur Sessions Court with 18 counts of money laundering involving RM5.59 million.

Wan Saiful, 48, was charged under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 [Act 613].

However, he pleaded not guilty to all charges and requested a trial.

Elaborating further, during the trial at the court today, Wan Saiful mentioned that the witness in the case seemed determined to link him to Tan Sri Muhyiddin Yassin.

He said this occurred during cross-examination by his lawyers involving the witness, Datin Rosni Yusoff, a former Deputy Secretary of the Government Procurement Division, regarding the awarding of contracts.

“Initially, she confirmed that all processes were correct and that Finance Minister Tengku Zafrul fulfilled his legal responsibilities in selecting the contractor.

“However, during cross-examination, Datin Rosni initially stated that she knew Tan Sri Muhyiddin had resigned on 16 August 2021. But when my lawyer mentioned that the contract was awarded in April 2022, and asked Datin Rosni who the Prime Minister was in April 2022, she suddenly said she thought Tan Sri Muhyiddin was still Prime Minister.

“Even though she had just said that Tan Sri Muhyiddin resigned in August 2021. The events today are truly strange,” he said. – November 15, 2024
