Najib seeks court to cite ex-AG Terrirudin for contempt over addendum order

KUALA LUMPUR — Datuk Seri Najib Razak will file for a contempt of court order against former Attorney-General (AG) Tan Sri Ahmad Terrirudin Mohd Salleh over the purported royal addendum order for the imprisoned former prime minister’s home detention.

Najib’s lawyer Tan Sri Muhammad Shafee Abdullah said the application would be filed in the high court here by Friday at the latest.

“The application is because, we now know from the Prime Minister’s statement, that the addendum order was received by the former AG, who somehow passed it on to the next Agong.

“The addendum is a decree by the Agong. It should be enforced, rather than to pass it around,” Shafee said at a press conference today.

“So we feel it was not honest on the part of the former AG because when, before the high court judge, there was total silence (about the addendum order). They (the prosecution) even challenged us to prove it exists, otherwise it’s hearsay.”

Shafee was referring to Prime Minister Datuk Seri Anwar Ibrahim’s statement on Jan 11, who said the addendum order, dated Jan 29, 2024, had been given by the outgoing Yang di-Pertuan Agong directly to the then AG. This was Terrirudin, who is now a Federal Court judge.

Anwar also said the then AG subsequently handed the addendum order to Istana Negara, as there was a change in Agong. The order was never brought to him as prime minister not to the Federal Territories Pardons Board.

Najib’s application for judicial review on the royal addendum order is back in the high court under a different judge, after the Court of Appeal granted him permission last month to proceed with the review.

Shafee also told reporters that Najib may file a second application for pardon, or for parole, but “without prejudice” as to his judicial review pursuit in the high court to compel the government to prove the existence the addendum order and to enforce it.

He said while there is so far no second application for pardon, the defence team was “contemplating” it while not giving up the judicial review.

Najib, 71, is currently serving a six-year prison sentence after being convicted of misappropriating RM42 million from SRC International Sdn Bhd.

He was originally sentenced to 12 years in prison with a fine of RM210 million. Following his petition for a pardon, this was reduced to six years and RM50 million on Jan 29, 2024, by the Federal Territories Pardons Board which the Yang di-Pertuan Agong chairs. – February 12, 2025
