What does AGC say about withdrawing police reports? – Hafiz Hassan

According to its e-Participation Policy portal, complainant may submit an application so no action taken on lodged report but decision lies with public prosecutor

12:55 PM MYT

THE Attorney-General’s Chambers (AGC) has an e-Participation Policy aimed at initiating a culture and practice of e-participation to improve transparency and public participation in enhancing the AGC’s service quality.

The policy is the AGC’s recognition of public involvement in enabling the country’s top law officers to explore wider perspectives, information resources and potential solutions to improve services to the public.

It also provides the basis for a productive relationship, dialogue, better consultation, and orderly governance.

Through e-participation, the AGC hopes to involve citizens in development policy and decision-making through the use of information and communication technologies.

Each of the AGC’s ten divisions has several questions that offer information about each division.

The prosecution division has three questions, one of which is: “Can I withdraw the police report that I had lodged?”

The answer is: “A police report cannot be withdrawn. However, a complainant may make a written application so that no action is taken on the report lodged. Although the complainant may make such an application, the final decision is still vested in the public prosecutor.

“The public prosecutor has the power to allow or reject the application and the decision is based on the facts and circumstances of each case.”
